BOLDLY's own announcement states it obtained permission from the Tokyo Metropolitan Public Safety Commission on 21 June 2024 to operate the ARMA bus at Level 4 on approved roads within HICity (confirmed via search-engine indexing of the operator's page, since the page itself returns an HTTP 403 to automated retrieval). Level 4 removes the legal requirement for an occupant to be ready to intervene "under certain conditions" -- it is a conditional classification, not by itself proof that nobody was aboard.
Caveat
A Level 4 permit changes what the law requires, not necessarily what actually happened on the bus. Coverage of this same announcement describes a "specified automated operation supervisor" remaining on board "for the time being" to guide passengers and to drive manually whenever conditions for autonomous operation are not met, with the removal of on-board staff described only as a future plan.
